Terms of Service

These Terms of Service ("Terms") govern your use of buildertrackpro.com (the "Website") and of BuildTrack Pro, the construction management and real estate CRM platform operated by Cotech Innovations ("we", "us", "our") from Bangalore, Karnataka, India (the "Service"). By using the Website, starting a trial or subscribing to the Service, you agree to these Terms on behalf of yourself and the business you represent (the "Customer"). If you do not agree, please do not use the Service.

1. The Service

BuildTrack Pro is a web-based platform that includes a real estate CRM (lead pipeline, site visits, quotations) and construction project management (stages, tasks, finance, documents, client portal). Features may be added, improved or changed over time. We may release updates without notice, but we will not remove core paid features without reasonable notice.

2. Who may use it

The Service is for businesses and professionals. You must be at least 18 years old and able to enter a binding contract. The person who signs up confirms they have authority to bind the Customer.

3. Accounts and users

• You are responsible for the accuracy of the information you give us and for all activity under your Customer's accounts.
• Keep login details confidential and give each team member their own login. Tell us promptly if you suspect unauthorised access.
• The plan includes unlimited users, projects and leads, subject to fair use and to these Terms.

4. Free trial and demo

We offer a free 30-minute demo and a 30-day free trial with no credit card required. A trial is provided for evaluation only, "as is", and we may end an abusive or unlawful trial at any time. At the end of the trial, you may subscribe to a paid plan or stop using the Service.

5. Fees and payment

• The Service is sold as a single annual plan. At the time of writing the price is ₹18,875 per year including 18% GST (₹15,996 plus GST). Current pricing is always shown on our pricing page.
• Fees are charged annually in advance. Monthly billing is not currently offered.
• Onboarding, configuration, branding setup, data import and team training are included at no extra charge.
• Fees are stated in Indian rupees. Taxes, including GST, are added or included as shown on your invoice. We will issue a tax invoice for each payment.
• There is no lock-in. You may renew at the end of your annual term or choose not to. If we change our prices, the new price applies from your next renewal and we will tell you in advance.
• For any billing question or dispute, please contact us at info@cotechin.com promptly so we can resolve it.

6. Your data

• Ownership. You own the data you put into the Service ("Customer Data"). We do not claim any ownership of it.
• Our use. You allow us to host, process and back up Customer Data only to provide, secure and support the Service. We never sell Customer Data or share it for advertising.
• Your responsibility. You are responsible for having the right to enter Customer Data, including leads, client and employee details, and for complying with data protection laws that apply to you.
• Export. You can request a full export of your projects, leads, quotations, documents and finance data at any time, including after your plan ends.

7. Acceptable use

You agree not to:

• Use the Service for anything unlawful, fraudulent, misleading or harmful
• Upload malware, or attempt to breach, probe or disrupt the Service or other customers' data
• Copy, resell, sublicense, reverse engineer or build a competing product from the Service, except as the law allows
• Send spam or unsolicited messages through the Service, or contact people in breach of applicable law, including telecom and do-not-disturb rules
• Share your login with people outside your business, or use the Service beyond what your plan allows

We may suspend access if we reasonably believe these rules are broken or the Service is at risk, and we will try to tell you why.

8. Custom branding

You may add your own company name and logo to the Service, quotations and the client portal. You confirm you have the right to use them, and you give us permission to display them as part of providing the Service to you.

9. Our intellectual property

We and our licensors own the Service, the Website, the BuildTrack Pro and Cotech Innovations names and logos, and all related software, designs and content. These Terms give you a limited, non-exclusive, non-transferable right to use the Service for your internal business during your plan. No other rights are granted.

10. Feedback

If you send us ideas or suggestions about the Service, we may use them without obligation to you, and without sharing any of your Customer Data.

11. Support and availability

We provide onboarding, training and support through email, phone and WhatsApp, usually Monday to Saturday, 9am to 7pm IST. We work to keep the Service available and reliable, but we do not promise it will be uninterrupted or error-free. Planned maintenance and events outside our control may cause downtime.

12. Disclaimers

To the fullest extent permitted by law, the Service and the Website are provided "as is" and "as available". We do not give any warranty other than those that cannot be excluded by law. In particular, quotations, cost estimates, lead scores, reports and similar outputs are tools to help you, and you are responsible for checking them before relying on them in your business, including any price you quote to a client.

13. Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special or consequential loss, or for loss of profit, revenue, business, goodwill or data, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the fees you paid us for the Service in the 12 months before the event that gave rise to the claim. Nothing in these Terms limits liability that cannot be limited by law, such as for fraud or wilful misconduct.

14. Your responsibility for claims

You agree to cover reasonable losses we suffer from a third-party claim caused by your Customer Data or by your breach of these Terms or of the law, as long as we promptly tell you about the claim and let you help defend it.

15. Ending the agreement

• You may stop using the Service at any time, and your plan will simply not renew at the end of the term.
• We may end or suspend your access if you materially breach these Terms and do not fix it within a reasonable time after we tell you, or immediately for serious misuse.
• After the Service ends, we will make your Customer Data available for export for a reasonable period, and then delete it unless the law requires us to keep it.
• Sections that by their nature should continue after the Terms end will continue, including data, intellectual property, disclaimers, liability and governing law.

16. Using the Website

Information on the Website is for general information about our products and is not professional advice. We try to keep it accurate, but prices, features and availability may change. Links to third-party sites are for convenience and we are not responsible for their content.

17. Governing law and disputes

These Terms are governed by the laws of India. We encourage you to contact us first so we can try to resolve any dispute informally. Any dispute that cannot be resolved this way is subject to the exclusive jurisdiction of the courts at Bengaluru, Karnataka.

18. Changes to these Terms

We may update these Terms from time to time. We will post the new version here with a new "Last updated" date, and tell active customers by email about material changes. Continued use of the Service after a change means you accept the updated Terms.
